The federal government has announced stronger penalties for employers who violate conditions of the Temporary Foreign Worker Program (TFWP). Employers found breaking the rules may face warnings, fines, and bans on future applications to the program. These changes will come into force on Dec. 1, 2015, and will apply to violations on or after that date.
Restaurants Canada has flagged several concerns with the new proposals, especially with potential penalties for non-compliance resulting from “good faith errors.” We are pleased to see the government listened, and new regulations allow employers to voluntarily disclose non-compliance with reduced consequences. We have asked for clarification on what those consequences would be.
A survey conducted in late 2014 found 76% of you have problems understanding TFWP rules and regulations. You also reported difficulty getting clear and consistent answers from Service Canada when you asked how to ensure you are in compliance.
