Effective June 10, employers in Ontario can’t take any portion of an employee’s tips except under very specific situations. See issue note here.
Even an automatic charge on banquets or events could be seen as a tip under the legislation if it’s reasonable that the customer thought the charge was intended for the employees. Consider how you might clarify what the service charges are for, such as “This charge covers administration of the event.”
